LAST WILL & TESTAMENT OF JAMES WEST of LINCOLN COUNTY, TENNESSEE (Written 6 May 1850)
I, James West do make and publish this my last will and testament hereby revoking and making void all other wills by me at any time made.
First, I give to the first of my sons, William, five dollars.
Second, I give to my son Rhodes West five dollars.
Third I give to my son James five dollars.
Fourth I give to my daughter Margaret Devine five dollars.
Sixth I give to my daughter Elizabeth Heins [heirs] five dollars.
Seventh I give to my daughter Sarah five dollars.
Eighth I give to my wife Margaretta, my sons Josephus and Andrew Jackson my tract of land that I now live upon to have and possess equally during the life or widowhood of my wife and should she marry to any other or at her death, I give to be equally divided between my two sons Josephus West and Andrew Jackson West.
I also give my wife Margaret, my son Josephus and my son Andrew Jackson each one bed, bedstead and furniture and also the remaining part of my household and kitchen furnishings. I also give to these my stock, horses, birds, hogs and sheep, my oxen, my cart and all farming utensils.
I give to my two sons, Josephus and Andrew Jackson, my gun and all my books to be equally divided between the two.
I also have five notes in Pleasant Holbert not yet due which I want to be collected and out of these to pay all my just debts and Funeral expenses and the remainder if any to be equally divided between my wife and two sons, Josephus and Andrew Jackson.
Lastly, I do hereby nominate and appoint Pleasant Holbert my executor in relief thereof. I do to this my will and set my hand and seal this 6 th day of May 1850.

In this cause it appeared to the court that Elizabeth, Neil, Richard, children of Wyatt West and Thomas + Ann West, children of James West are minors under twenty one years and have no regular gaurdians it is therefore ordered that C. C. McKinney be appointed gaurdian ad litem for said minors to reason complaintants bill and counsel to represent their interests in this cause....
